What happened

The Landlord obtained an ex parte eviction order after the Tenant failed to meet a condition of a previous payment plan order. The Tenant filed a motion to set aside the eviction, citing urgent hospitalization and the theft of her phone and purse, which prevented her from making the required payment electronically. The Tenant has since made partial payments and proposed a new plan to settle the remaining arrears.

The ruling

The motion to set aside the eviction order issued on July 4, 2025, is granted. The previous order is cancelled and replaced with a new payment plan. The Tenant is ordered to pay $1,826.00 in installments starting August 20, 2025, and ending November 20, 2025. The Tenant must also pay ongoing rent on time. If the Tenant fails to make any payment, the Landlord may apply for an eviction order without further notice.
