What happened

The Tenants applied for an order claiming the Landlord illegally altered the locks and substantially interfered with their enjoyment of the unit. The Landlord countered that the tenancy had already been legally terminated via a previous LTB order for non-payment of rent, which was enforced by the Sheriff. Tenant 2 admitted knowledge of the eviction order and the Sheriff's notice prior to the lockout but failed to challenge the original order.

The ruling

The Tenants' application is dismissed. The Board determined that the alleged illegal lockout and interference were the lawful result of an eviction executed by the Sheriff. The Tenants were aware of the prior eviction order and failed to challenge it through the appropriate legal channels (a request for review) before the enforcement took place.
