What happened
The Landlord applied for an order to terminate the tenancy because the Tenant was persistently late in paying rent. The evidence showed that between January 1, 2024, and July 1, 2025, the Tenant paid rent late 18 times. Even after being served with the notice of termination, the Tenant continued to pay rent late for August, September, and October 2025. At the hearing, the Tenant agreed to a 'pay on time' order, and the Landlord accepted this as a condition for relief from eviction.
The ruling
The tenancy is allowed to continue provided the Tenant pays November 2025 rent by November 18, 2025, and pays all future rent in full and on time from December 1, 2025, to November 1, 2026. The Tenant is also ordered to pay the Landlord $186.00 for the application filing fee by November 25, 2025. If the Tenant breaches these payment conditions, the Landlord can apply for an eviction order without further notice to the Tenant.
