What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to persistent late payment of rent. The Landlord provided evidence that the Tenants had paid rent late for 20 consecutive months between January 2024 and August 2025. The Tenants did not dispute the late payments but requested relief from eviction based on a change in financial circumstances.

The ruling

The LTB granted relief from eviction on the condition that the Tenants pay their November 2025 rent by November 23, 2025, and consistently pay their rent in full and on time on the first of every month from December 2025 through November 2026. If the Tenants fail to meet these conditions, the Landlord may apply for an ex parte eviction order within 30 days of the breach.
