What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The application was filed after serving valid N4 and N8 notices, which the tenants did not void by paying the arrears.

The ruling

The tenancy will continue if the Tenants pay the rent arrears of $18,769.50 and new rent on time according to the payment schedule. If the Tenants fail to make any payment, the Landlord can apply to terminate the tenancy and evict the Tenants. The Tenants must also pay $1,061.52 for unpaid utility and snow removal costs.
