What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant for non-payment of rent. The Tenant had not made any rent payments since April 2024, leading to substantial arrears. The Tenant's agent explained this was due to the Tenant's incarceration over the last year, with release in April 2025. A repayment plan was proposed but rejected by the Member due to lack of financial information and the Tenant's failure to comply with a previous interim order to pay rent.
The ruling
The tenancy is terminated effective July 31, 2025, unless the Tenant voids the order by paying either $16,468.00 by June 30, 2025, or $17,614.00 by July 31, 2025. If the order is not voided, the Tenant must pay the Landlord $16,264.00 for rent arrears and the application fee, plus daily compensation of $37.68 from June 26, 2025, until vacating. The LTB Member rejected a repayment plan due to the Tenant's failure to comply with a previous interim order, but postponed the eviction to provide the Tenant time to find new housing due to hardship.
