What happened
The Landlord applied to terminate the tenancy because she requires the rental unit for the residential occupation of her 79-year-old mother, who has significant health issues. The Tenants contested the application, alleging bad faith and claiming the Landlord's motive was to renovate and re-rent the unit at a higher price following a failed rent increase negotiation in 2023. The ruling
The LTB ordered the termination of the tenancy effective August 31, 2025. The Landlord was successful in proving the good faith requirement for personal use by her mother. While the Tenants raised concerns about retaliation and bad faith, the Board found no evidence to support these claims but granted an extended move-out date to accommodate the Tenants' family and financial needs.
