What happened

The Landlord applied for eviction and termination of tenancy due to non-payment of rent. The Tenant raised Section 82 issues regarding a deactivated key fob and a broken shower head that leaked and had poor pressure. While the Landlord was found not responsible for the key fob issue as it was a system error the Tenant failed to rectify at the management office, the Landlord was found to have breached maintenance obligations regarding the shower head. The Tenant had not paid rent despite having the financial capacity to do so, leading to the denial of relief from eviction.

The ruling

The tenancy is terminated effective July 8, 2025, unless the Tenant voids the order by paying the full amount owing. The Tenant is ordered to pay $5,329.20, which accounts for rent arrears and the application fee, minus a $200.00 maintenance abatement for a faulty shower head. The request for relief from eviction was denied because the Tenant failed to make any rent payments despite having significant disposable income.
