What happened
Tenant filed a T6 application regarding the Landlord's failure to meet maintenance obligations. The unit had unfinished flooring at move-in, which the Tenant finished herself with the Landlord's promise of reimbursement. Subsequently, the unit suffered two major floods (March and April 2025) which caused electrical failures and made the unit uninhabitable. The Tenant eventually moved out and sought rent abatement, reimbursement for repairs, and termination of the tenancy.
The ruling
The LTB ordered the Landlord to pay the Tenant $1,538.11. This includes a rent abatement of $487.12 for periods when the unit was flooded and uninhabitable, $1,002.99 to reimburse the Tenant for flooring repairs she performed, and the $48.00 application fee. The tenancy was officially terminated as of April 3, 2025, the date the Tenant vacated due to safety concerns.
