What happened

The Landlords initially applied for an order to terminate the tenancy and evict the Tenants after a breach of conditions in a mediated settlement regarding rent. A previous order was issued without a hearing, which the Tenants then moved to set aside. Following a subsequent order, Tenant 2 requested a review, claiming that medical issues related to blood sugar management prevented their reasonable participation in the proceedings.

The ruling

The LTB denied the request to review order LTB-L-083244-25-SA. The adjudicator determined that Tenant 2's medical explanation regarding blood sugar management did not sufficiently justify their absence from the videoconference or telephone hearing. The previous order remains in effect.
