What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit on the hearing date.
The ruling
The tenancy is terminated unless the Tenant voids the order by paying the outstanding rent arrears of $5,119 by December 31, 2024, $7,246 by January 31, 2025, or $9,373 by February 28, 2025. If the Tenant does not void the order, they must vacate the unit by February 28, 2025. The Landlord is entitled to compensation of $69.93 per day for use of the unit starting November 28, 2024 until the Tenant vacates.
