What happened

The Landlord applied for an ex parte order to terminate the tenancy after the Tenant allegedly breached a condition of a previous LTB order from March 2025. An eviction order was issued on June 26, 2025, without a hearing. The Tenant filed a motion to set aside that order, explaining that a delay in social assistance funding caused a late payment of arrears and a minor shortfall, which has since been corrected.

The ruling

The LTB granted the Tenant's motion to set aside the eviction order issued on June 26, 2025. The Adjudicator found that the Tenant's breach of a previous payment order was minor and caused by delays in receiving housing stabilization funds. Since the Tenant has paid all arrears and continues to pay rent, the eviction order was deemed unfair and was set aside.
