What happened
The Landlords applied to terminate the tenancy and evict the Tenant due to significant rent arrears (L1 application) and persistent late payment of rent (L2 application). The Tenant attended the hearing, disputed the arrears, and requested an adjournment citing mental health challenges and a need to review bank records. The Board denied the adjournment due to the large amount of arrears and lack of evidence that the Tenant had made any effort to resolve the issue. The Board found both the non-payment and persistent late payment claims to be substantiated.
The ruling
The tenancy is terminated based on the L2 application for persistent late payment of rent, with the Tenant required to move out by June 30, 2025. The Tenant is ordered to pay the Landlords $34,136.25, which covers rent arrears and the application fee, minus the rent deposit and its interest. Additionally, the Tenant must pay daily compensation of $49.32 from May 29, 2025, until vacating the unit.
