What happened

The Landlord applied to terminate the tenancy for personal use (N12). At the hearing, the Tenant raised a preliminary issue regarding the validity of the notice. The rental property contained multiple units (main floor and basement), but the Landlord's N12 notice only listed the general municipal address without specifying which unit was being terminated. The Board considered whether this lack of identification invalidated the notice.

The ruling

The Landlord's application to terminate the tenancy for personal use is dismissed. The N12 notice served by the Landlord was found to be invalid because it failed to specifically identify the Tenant's rental unit in a house that contains multiple separate units. Strict compliance with the identification requirements of the Residential Tenancies Act is mandatory.
