What happened

Landlord applied to terminate the tenancy and evict the Tenant due to the Tenant substantially interfering with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant, the Tenant wilfully or negligently causing damage to the premises, and the Tenant seriously impairing the safety of any person in the residential complex. The Landlord also claimed compensation for the Tenant's continued occupancy and for the Tenant's failure to pay utility costs.

The ruling

The tenancy is terminated effective March 4, 2023. The Tenant must pay the Landlord $2,085.02, which includes unpaid utilities and damage costs, less the rent deposit and interest. The Tenant must also pay $20.38 per day in compensation for continued occupancy starting February 7, 2023 until the Tenant vacates. If the Tenant does not pay the full amount by March 4, 2023, the Tenant will owe 5% annual interest on the outstanding balance.
