What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. Despite serving a valid N4 notice, the Tenants failed to pay the arrears before the application was filed or the hearing took place. The Tenants did not attend the hearing, and evidence showed a significant balance of rent arrears exceeding $10,000. While some payments were made after filing, they were insufficient to cover the mounting debt.
The ruling
The tenancy is terminated effective July 11, 2025, unless the Tenants pay $10,969.56 by June 30, 2025, or $12,387.90 by July 11, 2025, to void the order. If the Tenants do not void the order, they must vacate by July 11, 2025, and pay the Landlord $10,390.56 plus daily compensation of $46.63 from June 19, 2025, until they move out.
