What happened

The Landlord applied for an order to terminate the tenancy and evict the Tenants due to persistent late payment of rent. An N8 notice was served after the Tenants paid rent late 15 times over a 15-month period. Even after the notice was served, late payments continued. The Tenants did not attend the hearing.

The ruling

The LTB denied the Landlord's request for eviction on the condition that the Tenants pay their monthly rent on time for 12 consecutive months starting July 1, 2025. The Tenants are also ordered to pay the Landlord $186.00 for the filing fee. Failure to pay rent on time within the next year allows the Landlord to apply for an eviction order under section 78 without further notice to the Tenants.
