What happened

The Landlord applied to terminate the tenancy of the Estate and evict an unauthorized occupant. The original tenant passed away in March 2024. As the unit is a mobile home/trailer on a leased plot, the tenancy continued with the Estate. The Estate Trustee allowed an unidentified colleague to reside in the unit without the Landlord's consent to monitor it for insurance purposes and perform repairs while attempting to sell the trailer. The Landlord discovered this occupancy in March 2025 and filed the application within the 60-day limit.

The ruling

The LTB terminated the tenancy and ordered the unauthorized occupant to vacate by December 31, 2025. The Tenant (Estate) is responsible for paying a daily compensation of $17.47 from October 1, 2025, until the unit is vacated, plus the $201.00 filing fee. The eviction was postponed to facilitate the sale of the trailer by the Estate Trustee.
