What happened
The Landlord applied to terminate the tenancy and evict the deceased Tenant's son, who was deemed an Unauthorized Occupant. The son had been the Tenant's caregiver and continued to live in the rental unit after the Tenant's death on June 25, 2023, without informing the Landlord for over a year. The Landlord also sought compensation for the unit's use and for NSF cheque fees.
The ruling
The tenancy is terminated effective July 25, 2023. The Unauthorized Occupant must vacate the rental unit by May 5, 2025. The Unauthorized Occupant is ordered to pay the Landlord $3,146.92, which covers compensation for use of the unit until the hearing date, NSF fees, and the application filing cost. Additionally, daily compensation of $18.48 is to be paid from February 28, 2025, until the unit is vacated.
