What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The Landlord was not able to attend the initial hearing on February 2, 2023 due to technical difficulties, and requested a review of the order issued on that date.

The ruling

The Landlord's request for review is granted. The tenancy is terminated unless the Tenants pay $8,952.48 by April 30, 2023 or $10,505.67 by May 31, 2023 to void the order. If the Tenants do not void the order, they must vacate the unit by May 31, 2023 and pay the Landlord $5,509.32 plus daily compensation of $51.06 from March 24, 2023 until move-out.
