What happened

The landlord applied for an order to terminate the tenancy and evict the tenants due to their failure to meet a condition specified in a previous LTB order, which required them to pay $450 towards rent arrears by January 28, 2023, and the lawful rent by February 1, 2023. The tenants failed to make these payments.

The ruling

The tenancy is terminated effective April 24, 2023, and the tenants must vacate the rental unit by that date. The tenants are ordered to pay the landlord $14,916.35, which includes the remaining rent arrears from the previous order and the rent arrears that accrued since then, less the rent deposit and interest owed to the tenants. The tenants will also owe the landlord $38.18 per day for each day they occupy the unit after April 14, 2023.
