What happened

The landlord applied to terminate the tenancy and evict the tenant due to the tenant or another occupant committing an illegal act or carrying out an illegal trade, business or occupation in the rental unit or residential complex. The landlord also applied for an order requiring the tenant to pay for damages caused wilfully or negligently.

The ruling

The tenancy between the landlord and tenant is terminated, and the tenant must vacate the rental unit by May 31, 2023. If the unit is not vacated by that date, the landlord may file the order with the Court Enforcement Office for enforcement. The tenant caused $35,000 in damages, but the landlord will waive the damages if the tenant vacates by the termination date. If the tenant does not vacate, the full amount of damages becomes due on June 1, 2023 and will accrue 6% annual interest.
