What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year by their son Gayank Patel.
The ruling
The tenancy is terminated, and the Tenant must move out of the rental unit on or before April 14, 2023. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) to enforce the eviction. The Tenant shall pay the Landlord $6,286.97, which represents compensation for the use of the unit from November 1, 2022 to March 22, 2023, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenant shall also pay the Landlord $79.85 per day for the use of the unit starting March 23, 2023 until the date the Tenant moves out.
