What happened
The Landlord applied to terminate the tenancy and evict the Tenants due to non-payment of rent. The last rent payment was made in October 2024, resulting in significant arrears. At the hearing, one of the Tenants claimed their bank account was frozen but provided no evidence. The Landlord expressed financial hardship, stating they are also renting and cannot carry the property costs without rent. The Tenants requested a delayed eviction, which was denied.
The ruling
The tenancy is terminated unless the Tenants pay the outstanding rent. They can void the order by paying $24,336.00 by May 31, 2025, or $27,786.00 by June 3, 2025. If they fail to pay, they must vacate by June 3, 2025. If the tenancy terminates, the Tenants are ordered to pay the Landlord $18,629.50 plus daily compensation of $113.42 from May 13, 2025, until they move out.
