What happened
Landlord applied for an order to terminate the tenancy and evict the Tenants due to their failure to pay the utilities they were required to pay under the terms of the tenancy agreement. The Landlord served the Tenants with an N5 notice, but the Tenants did not void the notice by paying the outstanding water costs.
The ruling
The tenancy is terminated effective January 4, 2024. The Tenants are ordered to pay $1,851.10 in unpaid water bills and $186 for the cost of filing the application. The Landlord owes the Tenants $421.85, which is the last month's rent deposit and interest, minus the unpaid utilities and filing fee. The Tenants also owe any water costs incurred after October 19, 2023.
