What happened
The Tenant requested a review of an eviction order issued on October 3, 2024, following a hearing he did not attend. The Tenant claimed he was hospitalized and unaware of the original hearing or order until receiving a Sheriff's Notice to Vacate. However, evidence showed the Tenant received a letter from the Landlord regarding the order in October 2024, leading to an unexplained four-month delay in filing for review.
The ruling
The Landlord and Tenant Board denied the Tenant's request to review the eviction order. The Board found that while the Tenant claimed hospitalization as a reason for missing the initial hearing, he admitted to being aware of the order as of October 2024 but failed to act for four months. Consequently, the stay of eviction was lifted immediately, and the original order for termination of tenancy remains in effect.
