What happened

The Landlords applied for rent arrears after the Tenants vacated the rental unit on August 24, 2024, breaking their fixed-term lease which was set to end on October 31, 2024. At the hearing, Tenant 1's request to raise issues regarding tenant's rights under section 82 of the Act was denied due to failure to provide the required 7-day notice to the Landlords and the Board. The Board found the Tenants liable for the rent until the end of the fixed lease term.

The ruling

The Tenants must pay the Landlords $5,020.89 for unpaid rent until the end of their fixed-term lease, plus the application fee, less the rent deposit and interest. The Tenants vacated early, but were found liable for the full term's rent as the tenancy was not lawfully terminated. The Tenant's attempt to raise issues about their rights was denied due to not following proper procedure.
