What happened

The Tenant requested a review of a prior order (LTB-L-051417-24) that found the Residential Tenancies Act did not apply to their tenancy. The Tenant argued there was a serious error in the order and they were unable to participate in the original hearing. The Board denied the review, stating the Tenant was adequately represented by counsel at the hearing and their absence was due to personal travel, not confusion about the hearing. The Board also found no serious error in the original member's determination that the accommodation was temporary and thus exempt from the Act.

The ruling

The Tenant's request to review the order of June 5, 2025 is denied. The original order, which determined the Residential Tenancies Act does not apply to the rental unit, is confirmed and remains unchanged.
