What happened
Tenants applied for an order determining that the Landlord collected or retained money illegally. The Tenants had special needs and were assisted by their parents. The Tenants alleged that the Landlord illegally retained their last month's rent deposit and did not pay the compensation required for giving the Tenants a notice of termination for repairs.
The ruling
The Landlord must pay the Tenant a total of $5,435.76, which includes a rent rebate of $887.76 and compensation of $4,500.00 for the Landlord's notice to terminate the tenancy for repairs. The Landlord must pay the full amount by September 30, 2024, and will owe interest if the amount is not paid by that date.
