What happened

The Landlord applied to terminate the tenancy for personal use (N12). The application was dismissed because the Landlord failed to serve the N12 notice on all tenants listed on the lease. Specifically, the Landlord omitted Tenant 3 (the adult sister of Tenant 1) from the notice and the application based on an incorrect assumption that she had moved out because he had not seen her during annual visits.

The ruling

The Landlord's application to terminate the tenancy for personal use is dismissed. The N12 notice was found to be invalid as it failed to name and serve all legal tenants listed on the rental agreement. The tenancy continues.
