What happened
Jasodra Persaud ('JP') applied for an order to terminate the tenancy and evict Yvonne Facey (the 'Tenant') because JP in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year. JP also claimed compensation for each day the Tenant remained in the unit after the termination date.
The ruling
The Landlord's application is dismissed. The Tenant must pay to JP $650.00, which was given by JP in satisfaction of the required compensation under section 48.1 of the Act. If the Tenant does not pay JP the full amount owing on or before September 30, 2024, the Tenant will start to owe interest.
