What happened

The Landlord applied to terminate the tenancy because the Tenant failed to meet a condition of a previous LTB order. An eviction order was initially issued without a hearing on August 1, 2025. The Tenant subsequently filed a motion to set aside that order. During the hearing for the motion, the parties reached a consent agreement regarding the repayment of rent arrears.

The ruling

The LTB granted the Tenant's motion to set aside a previous eviction order. The parties consented to a new order requiring the Tenant to pay $7,835.20 in arrears. The payment plan consists of $250.00 monthly installments starting October 1, 2025, until May 1, 2028, with a final payment of $85.00 in June 2028. The Tenant must also pay ongoing rent in full and on time. Any failure to comply will allow the Landlord to seek an ex parte eviction order within 30 days of the breach.
