What happened

The Landlord applied for an order to terminate the tenancy due to non-payment of rent. The Tenant raised a preliminary issue regarding multiple N4 notices but conceded they were not confusing and agreed with the arrears amount. The Tenant admitted to being unable to afford the rent and requested a delay in eviction due to her father's significant health issues. The Board found the N4 notice valid and, after considering the circumstances under Section 83, granted a postponement of the eviction to allow the Tenant time to find new accommodation.

The ruling

The tenancy is terminated effective June 30, 2025, unless the Tenant pays $14,713.00 by that date to void the order. If the order is not voided, the Tenant must pay the Landlord $9,395.51, plus daily compensation of $62.17 from May 8, 2025, until vacating. The eviction was delayed under Section 83 to allow the Tenant time to find new housing due to her father's health issues.
