What happened
The Landlord applied for a review of a previous order that dismissed an eviction application for personal use. The Landlord contended that the original order contained an error by failing to order the Tenants to return the $2,574.00 compensation paid under section 73.1 of the Act, given that the eviction was not granted. During the review process, the Tenants moved out of the unit.
The ruling
The LTB granted the Landlord's review request in part. While the dismissal of the eviction was confirmed (and the unit was already vacated), the Board corrected a previous error by ordering the Tenants to repay the $2,574.00 in compensation previously provided by the Landlord for the N12 notice.
