What happened
Tenants applied for an order determining that the Former Landlords and Purchasers gave a notice of termination in bad faith. The Tenants moved out on March 30, 2023, following an N12 notice served on behalf of the Purchasers who claimed they required the unit for personal use. However, shortly after the Tenants vacated, the Purchasers renovated the unit and listed individual rooms for rent on Facebook. The Purchasers claimed a friend died on-site, which deterred them from moving in, but provided no evidence of this event.
The ruling
The Purchasers are ordered to pay the Tenants $8,398.00 by August 3, 2025. This includes $1,000.00 for rent abatement, $2,100.00 for rent differential, $1,250.00 for moving and storage expenses, $4,000.00 for general compensation, and the $48.00 filing fee. The Board found the Purchasers acted in bad faith by renting out the unit by room instead of moving in as declared.
