What happened
The Landlord applied for termination of tenancy and compensation for damages, alleging the Tenant willfully broke a window. Since the Tenant vacated the rental unit before the hearing, the Landlord withdrew the application to terminate the tenancy but proceeded with the claim for repair costs under section 89 of the Act. The Landlord provided evidence that the Tenant broke the window to gain entry after being locked out.
The ruling
The Tenant is ordered to pay the Landlord $586.00, covering $400.00 for willful damage to a window and the $186.00 filing fee. The Landlord's request for eviction was withdrawn as the Tenant had already moved out. Payment is due by August 8, 2025, after which interest will accrue.
