What happened
The Landlord applied for termination of tenancy and eviction due to non-payment of rent. The Tenants, who were in a joint tenancy, had significant arrears. One tenant had vacated the unit earlier but remained legally tied to the lease as the Landlord did not consent to severing the joint tenancy. The remaining tenant, whose primary income was from ODSP, requested relief from eviction and a payment plan, but the LTB found the tenancy unviable as her income was lower than the monthly rent.
The ruling
The tenancy is terminated effective November 30, 2025. The Tenants are ordered to pay $1,828.96 to the Landlord, representing arrears and filing fees minus the deposit and interest. The Tenants may void the eviction by paying $5,551.00 by November 30, 2025. Relief from eviction in the form of a payment plan was denied due to the tenant's lack of sufficient income to sustain the tenancy.
