What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to the Tenant, another occupant, or a person the Tenant permitted in the residential complex seriously impairing the safety of others. The Landlord alleged the Tenant caused fires by leaving items on the stove unattended on three occasions, triggering the fire alarm and requiring the fire department to respond.

The ruling

The Landlord's application for eviction of the Tenant is denied on the condition that the Tenant shall not use the stove or oven in a manner that results in causing smoke and/or fire at the residential complex. If the Tenant fails to comply with this condition, the Landlord may apply for an order terminating the tenancy and evicting the Tenant within 30 days of the breach. The Tenant shall also pay the Landlord $186.00 for the cost of filing the application.
