What happened

The Respondent (Landlord) requested a review of an order issued in her absence, claiming she never received the notice of hearing. The original application by the Applicant (Tenant) alleged lock changes and harassment. Upon review, the Board determined that the Residential Tenancies Act (RTA) did not apply to the arrangement because the property was booked as a short-term rental via Airbnb, falling under the Section 5(a) exemption for vacation or temporary living accommodations.

The ruling

The review request is granted, and the original order dated October 27, 2025, is cancelled. The Tenant's application is dismissed because the Residential Tenancies Act does not apply to this short-term Airbnb rental. The Board found the LTB has no jurisdiction over the matter.
