What happened
The Landlord sought to quash the appeal of Mr. Porringa, an unauthorized occupant, against a Landlord and Tenant Board order to terminate his occupancy and evict him from the premises. Mr. Porringa claimed he was a tenant with rights under the Residential Tenancies Act and alleged discrimination and Charter rights violations.
The ruling
The court quashed Mr. Porringa's appeal of the Landlord and Tenant Board's eviction order, finding it devoid of merit. The court vacated the automatic stay of the Board's decision and allowed the Landlord to file the eviction order with the Sheriff on January 15, 2021. Mr. Porringa was ordered to pay $4,000 in costs to the Landlord within 30 days.
