What happened
A large group of tenants applied for a rent abatement, alleging that the landlord substantially interfered with their reasonable enjoyment during a massive 5-year renovation project involving the residential complex's exterior, common areas, and infrastructure. The tenants cited constant noise, dust, safety concerns, privacy issues, and loss of amenities like courtyards and visitor parking.
The ruling
The Tenants' application for a rent abatement due to substantial interference was dismissed. While the Board acknowledged the significant impact of the five-year renovation on the tenants' lives, it determined that the landlord carried out necessary repairs in a reasonable manner considering the project's scale, the heritage status of the property, and the impact of the pandemic. Additionally, the tenants failed to provide specific evidence justifying an across-the-board 25% abatement for individuals across different buildings with varying experiences.
