What happened

Landlords applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant requested relief from eviction by proposing a repayment plan for the arrears and filing fee owing.

The ruling

The Landlords' application for eviction is denied on the condition that the Tenant pays $6,986.00 to the Landlords according to a specified payment plan. The Tenant must pay $300.00 monthly towards arrears for 23 months, $86.00 in the 24th month, and continue paying regular monthly rent. If the Tenant secures a debt consolidation loan, they are directed to pay as much as possible to reduce the arrears balance. Failure to comply with the payment conditions allows the Landlords to apply for termination under section 78 of the Act.
