What happened

The Tenant requested a review of a previous order (LTB-L-070146-25-SA) which had denied her motion to set aside an eviction order. The Tenant had previously consented to an order requiring her to vacate the unit by December 31, 2025. In her review request, she claimed that cognitive disabilities impaired her decision-making and that she felt she had no choice but to agree to the Landlord's terms. The LTB conducted a preliminary review of the request.

The ruling

The Tenant's request for a review of the order dated December 4, 2025, is denied. The original order, which requires the Tenant to vacate the rental unit on or before December 31, 2025, remains confirmed and unchanged. The Board found that the Tenant did not provide sufficient evidence to support her claim that cognitive disabilities prevented her from participating or consenting genuinely to the previous settlement.
