What happened

The Tenant requested a review of an eviction order, arguing that filing for a consumer proposal under the Bankruptcy and Insolvency Act (BIA) should stay the eviction. The LTB dismissed the review request, determining that while the BIA stays the collection of rent arrears, it does not stay the enforcement of an eviction order that was issued before the consumer proposal was filed.

The Tenant's request to review the eviction order is dismissed. The LTB confirmed the original order and cancelled the interim stay. The adjudicator found no serious error, ruling that filing a consumer proposal after an eviction order is issued does not prevent the Landlord from enforcing the eviction, although it does prevent collection of the rent arrears outside of the proposal process.
