What happened

The Landlord applied for an order to terminate the tenancy because the Tenant breached a condition of a previous LTB order (File LTB-L-104314-24) by failing to pay rent and arrears on July 1, 2025. This led to an ex-parte eviction order (LTB-L-055604-25) being issued on July 14, 2025. The Tenant subsequently filed a motion to set aside that eviction order, explaining that his failure to pay was due to health issues preventing him from working and causing a loss of union financial assistance.

The ruling

The Board established a new repayment schedule for the $4,924.40 owed (representing rent and arrears to September 30, 2025, plus the filing fee). The Tenant is required to make monthly payments starting October 1, 2025, and ending February 1, 2026, while also paying current rent on time. Failure to meet any payment allows the Landlord to apply for an eviction order without further notice.
