What happened

The Landlord applied for eviction and rent arrears. The Tenant claimed they never received the N4 termination notice or the N1 rent increase notice. The Landlord provided evidence of service via email and physical delivery. The LTB found the notices were validly served. The Tenant requested a payment plan and an extended termination date, but both were denied due to the significant arrears and the Tenant's poor payment history.

The ruling

The tenancy is terminated. To void the eviction and continue the tenancy, the Tenant must pay $21,455.60 by May 26, 2025. If the Tenant does not void the order, they must move out by May 26, 2025, and pay the Landlord $7,526.02 plus daily compensation of $100.60 from February 14, 2025, until they vacate.
