What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, but the Tenant did not void the notices or attend the hearing.

The ruling

The tenancy is terminated unless the Tenant pays $32,206 by January 23, 2024 to void the order. If the Tenant does not pay, they must vacate by January 23, 2024 and pay the Landlord $24,256.23 plus daily compensation of $85.48 from November 24, 2023 until move-out. If the Tenant voids the L1 portion, the tenancy will continue on the condition the Tenant pays rent on time.
