What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to non-payment of rent. The Tenants were served with a valid N4 notice but failed to void it. Although the Tenants made significant payments after the application was filed, reducing the total arrears, they remained in possession of the unit with outstanding rent at the time of the hearing.
The ruling
The tenancy is terminated effective September 30, 2025. The Tenants can void this order by paying $2,587.46 on or before September 30, 2025. If the tenancy is terminated and the Tenants move out, the Landlord actually owes the Tenants $1,625.15 because the applied rent deposit and interest exceed the arrears and fees, subject to daily compensation of $78.95 from September 9, 2025.
