What happened

The Tenant requested a review of an order terminating the tenancy and evicting him for non-payment of rent, which was originally issued following a hearing he did not attend. The Tenant claimed he was unable to participate due to a language barrier and a misunderstanding of the notice. The LTB Member found the Tenant's oral testimony at the review hearing to be inconsistent with his written review request and concluded that the Tenant was reasonably able to participate in the original proceeding.

The ruling

The LTB denied the Tenant's request to review the original eviction order. The adjudicator found that the Tenant's excuse for missing the original hearing—a language barrier—was not credible given inconsistencies in his statements and his demonstrated ability to speak English. The stay of the original order is lifted effective July 18, 2025, allowing time for the Tenant to pay his current July rent.
