What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to persistent late payment of rent. From January 2024 to December 2024, the Tenant paid rent late 12 out of 12 times. As of the hearing date, the Tenant also had significant arrears. The Tenant requested relief from eviction, citing long-term residency since 2017, the recent death of a family member, and a prior informal arrangement regarding payment dates with the previous owner.

The ruling

The Landlord's application for eviction is denied on the condition that the Tenant pays full monthly rent on or before the first business day of each month for 12 months, starting June 1, 2025. The Tenant is also ordered to pay the Landlord $186.00 for the application filing fee by May 18, 2025. If the Tenant fails to meet the payment conditions, the Landlord may apply for an eviction order without notice to the Tenant.
